The Queen v. B.(C.) 2016
The police received an informant tip that a certain vehicle was involved in drug trafficking. After observing three suspicious interactions, the police arrested the driver. No drugs were found in the vehicle, but hours later at the police detachment the police obtained significant amounts of heroin and cocaine in a package from the client’s rectum. He was charged with possession for the purposes of trafficking heroin and trafficking cocaine. At trial, after hearing argument from Mr. van der Walle, the judge ruled that all the evidence was inadmissible on the basis of constitutional violations. Not guilty of all charges. Client did not testify.
