An arrest warrant was issued for the client on a charge of impaired driving in Kelowna. For over a year and a half, police did very little to find the client and execute the warrant. The client was facing a criminal record, the loss of his driver’s licence and a possible jail sentence. As soon as Mr. van der Walle took on the case, he filed a Notice of Constitutional Motion arguing that the client’s right to be tried within a reasonable time had been violated because of the delay. Much to her credit, the Crown agreed with Mr. van der Walle and dropped all of the criminal charges. Not guilty of all criminal charges, no trial necessary.
