The client was charged in Kelowna with impaired driving and failing to appear in court. His first lawyer withdrew from the case after the client missed his original trial date. Mr. van der Walle was then hired and tried to set a new trial date as soon as possible, but the Crown was not available to proceed until much later. Mr. van der Walle filed a Notice of Constitutional Motion alleging that the client’s right to be tried within a reasonable time had been violated. One day before the motion was set to be argued, the Crown decided to drop both charges. Not guilty of all charges, no trial necessary.
